 Home : Reporting and Compliance : What Happens if My Report Does Not Comply : List of Non Compliant Organisations
Organisations, employing over 100 employees, covered under the Equal Opportunity for Women in the Workplace Act 1999 (the Act) need to self-identify to EOWA and as required under Sections 13, 13A and 13B of the Act, report annually to EOWA on their workplace program for women. Organisations are not compliant with the Act if they:

i) submit a non-compliant report and do not provide the required additional information;
ii) are registered with EOWA but do not submit a report;
iii) are covered under the Act but do not self-identify to EOWA.

Non-compliant organisations are not eligible for Commonwealth contracts for the procurement of goods and services. The policy applies to the purchasing of goods and services by all Commonwealth departments and agencies, with or without a written contract.

Employers that are non-compliant with the Act are also not eligible for Federal grants under specified industry assistance programs.

Procurement officers:

Must check if an intended supplier is compliant with the Act by:

  • checking the list of non-compliant organisations below and if the intended supplier's name is on the list, another supplier is to be chosen

Procurement officers are advised to:

  • ask organisations that are not on the non-compliant list below to provide a letter from EOWA that either confirms compliance with, or non-relevance under, the Act. If an organisation is unable to provide either of these letters, they will then need to contact EOWA to determine its relevance under the Act.

The following list names the 2010-11 non-compliant organisations
