> Feature Story - Employer Wins Discrimination Case
The recent case of Howard vs Geradin Pty Ltd (trading as Harvard Securities) in Victoria proves that organisations who take all 'reasonable precautions' to reduce the risk of  sexual harassment and discrimination in the workplace will not be held liable in court.

In 2003 Howard filed a sexual harassment complaint against one of her colleagues as well as Harvard Securities. The complaint against the colleague was settled, however, the complaint against the organisation went to trial.

The Victorian Civil and Administrative Tribunal based their decision on whether Harvard Securities had taken reasonable precautions to prevent their employee from breaching the Equal Opportunity Act 1995. Harvard Securities showed they have: a sexual harassment policy which employees are required to sign with their contracts upon employment; regular staff meetings where staff are regularly reminded of what kinds of behaviour can lead to harassment complaints; and a complaint officer who is known to all staff. The Tribunal was satisfied with these precautions and the organisation was not held liable for their employees misconduct.
